Red Apple Supplies: Volunteer Waiver of Liability

This release and waiver of liability (“The Release”), executed on today by accepting (“The Volunteer”), in favor of The Education Foundation of Palm Beach County (and its Red Apple Supply Store), a non-profit organization, its directors, officers, employees, agents, representatives and their successors and assigns, executors, heirs and administrators (collectively “The Education Foundation of Palm Beach County and its Red Apple Supply Store”)

COVID Safety Guidelines for Volunteering In Person

The Education Foundation and Red Apple Supplies has implemented several measures to promote health and safety during volunteer activities.

· We ask that if anyone in your group has a temperature, is not feeling well, has traveled out of the country, or has been exposed to or tested positive for COVID-19 refrain from volunteering for at least 1 week (minimum of 7 days).

· Masking is suggested but not required when volunteering.

· We ask that volunteers maintain as much social distancing as possible using floor decals as place markers, and follow all directional signage, when provided.

· In addition, we ask all volunteers to participate in good hygiene habits, such as proper handwashing and the use of hand sanitizer. Volunteers may also be asked to spend additional time cleaning their areas and may be asked to refrain from eating in the building (unless special circumstances arise).

The volunteer desires to volunteer for The Education Foundation of Palm Beach County (and its Red Apple Supply Store) and engage in the activities related to being a volunteer (“The Activities”). The volunteer understands that the activities may include but are not limited to providing transportation (using their own vehicle), carrying and lifting items, moving boxes of school supplies, loading boxes of school supplies into cars, carrying out basic warehouse work, participating in special events and fundraisers, and engaging in other activities relevant to the work of The Education Foundation of Palm Beach County (and its Red Apple Supply Store).

The volunteer hereby freely, voluntarily and without duress executes this Release under the following terms:

Release and Waiver: Volunteer does hereby release and forever discharge and hold harmless The Education Foundation of Palm Beach County (and its Red Apple Supply Store) and its successors and assigns from any and all liabilities, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from The Volunteer’s Activities at The Education Foundation of Palm Beach County (and its Red Apple Supply Store).

The Volunteer understands that this Release discharges The Education Foundation of Palm Beach County (and its Red Apple Supply Store) from any liability or claim that The Volunteer may have against The Education Foundation of Palm Beach County (and its Red Apple Supply Store) with respect to any bodily injury, personal injury, illness, death or property damage that may result from The Volunteer’s Activities at The Education Foundation of Palm Beach County (and its Red Apple Supply Store) unless caused by the gross negligence of The Education Foundation of Palm Beach County (and its Red Apple Supply Store) and its officers, directors, employees or otherwise.

The Volunteer also understands that The Education Foundation of Palm Beach County (and its Red Apple Supply Store) does not assume any responsibility or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of an injury or illness.

Medical Treatment: The Volunteer does hereby and forever release The Education Foundation of Palm Beach County (and its Red Apple Supply Store) from any claim whatsoever that arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with The Volunteer’s Activities with The Education Foundation of Palm Beach County (and its Red Apple Supply Store).

Assumption of Risk: The Volunteer understands that The Activities include work that may be hazardous to The Volunteer, including but not limited to transportation.

The Volunteer hereby expressly and specifically assumes the risk of injury or harm in The Activities and release The Education Foundation of Palm Beach County (and its Red Apple Supply Store) from all liability for injury, illness or death, or property damage resulting from The Activities.

Insurance: The Volunteer understands that The Education Foundation of Palm Beach County (and its Red Apple Supply Store) does not carry or maintain health, medical or disability insurance for any volunteer.

Photographic Release: The Volunteer does hereby grant and convey to The Education Foundation of Palm Beach County (and its Red Apple Supply Store) all rights and interest in any and all photographic images, video or audio recordings made by The Education Foundation of Palm Beach County (and its Red Apple Supply Store) during The Volunteer’s Activities with The Education Foundation of Palm Beach County (and its Red Apple Supply Store) including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.
